Please read these Terms & Conditions (“Terms”) carefully before using medicarebenefitscare.com (the “Site”). The Site is operated by Medicare Benefits Care and its partners (“Company,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.
1. Eligibility and acceptance
You must be at least 18 years of age (or the age of majority in your state) to use the Site. By using the Site, you represent that you meet this requirement and that information you provide is accurate to the best of your knowledge.
2. Not a government website; educational purpose
Content on the Site is for general educational and marketing purposes about Medicare-related insurance products. We are licensed insurance professionals and/or authorized representatives. We are not Medicare, CMS, the Social Security Administration, or any federal or state government agency. The Site does not provide tax, legal, or medical advice. Plan benefits, costs, networks, and rules are governed by official carrier documents (for example, Evidence of Coverage, Summary of Benefits, and plan contracts), which control if there is any conflict with Site content.
3. Licensing and appointments
Insurance products discussed on the Site are offered only where permitted by law and only by individuals and entities properly licensed and appointed. Availability of agents and plans varies by state and county. Nothing on the Site guarantees that a particular plan or agent is available in your area.
4. No obligation to enroll
Submitting a form, calling us, or speaking with an agent does not enroll you in a Medicare plan and does not obligate you to purchase any product. Enrollment requires completion of carrier-approved enrollment steps, eligibility verification, and acceptance by the plan.
5. Plan availability and TPMO disclosures
We do not offer every plan available in your area. We represent a limited number of Medicare-related organizations and products. Organization and product counts applicable to your service area will be disclosed on the Site as required by CMS and as provided by our Field Marketing Organization before the Site is used for public marketing. For information on all options in your area, contact Medicare.gov, call 1-800-MEDICARE, or contact your local State Health Insurance Assistance Program (SHIP).
6. Compensation
We may receive compensation from insurance carriers or other parties when you enroll in a plan we offer or through our marketing activities. Compensation does not affect your Medicare premiums or CMS payments to carriers. You are not charged by us for use of the Site to request information.
7. Communications and consent
If you provide consent on our forms, you authorize Company and its partners to contact you by phone, email, or text (including through automated technology where permitted by law) regarding Medicare Advantage, Medicare Supplement, and/or Prescription Drug Plans. Message and data rates may apply. Consent is not required to purchase services. You may revoke consent as described in our Privacy Policy and applicable law.
8. Acceptable use
You agree not to misuse the Site, including by attempting unauthorized access, scraping or harvesting data, introducing malware, interfering with Site operation, or submitting false or misleading information.
9. Intellectual property
Site content, branding, layout, text, graphics, and logos are owned by Company or licensors and are protected by intellectual property laws. You may view and print content for personal, non-commercial use. You may not copy, modify, distribute, or create derivative works without prior written permission, except as permitted by law.
10. Disclaimer of warranties
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, COMPANY AND ITS PARTNERS, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE MINIMUM AMOUNT REQUIRED BY APPLICABLE LAW, WHICHEVER IS GREATER.
Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the maximum extent permitted by law.
12. Indemnification
You agree to indemnify and hold harmless Company and its partners from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, violation of these Terms, or violation of any law or third-party rights.
13. Governing law and venue
These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles. You agree that exclusive jurisdiction and venue for disputes arising out of or relating to these Terms or the Site shall lie in the state or federal courts located in Clark County, Nevada, and you consent to personal jurisdiction in those courts.
14. Dispute resolution
Before filing a claim in court, you agree to contact us at info@medicarebenefitscare.com and attempt in good faith to resolve the dispute informally for at least thirty (30) days.
15. Severability; entire agreement; waiver
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect. These Terms, together with the Privacy Policy and any consent you provide on our forms, constitute the entire agreement regarding the Site. Our failure to enforce a provision is not a waiver of that provision.
16. Changes
We may update these Terms from time to time. Material changes will be indicated by updating the effective date. Your continued use of the Site after changes constitutes acceptance of the revised Terms.
